Warranty

Muskoka Living (“The Company”) warrants its products to be free from defects in material and workmanship under normal residential use and service. The Company’s limited warranty does not apply to fabric or any goods that are not manufactured by Muskoka Living. The Company’s sole and exclusive obligation under its limited warranty is to repair or replace at the Company’s discretion, all products that are returned to it within the applicable warranty period and judged by the Company to be defective.

No other representations and/or warranties, either expressed or implied are made with respect to the products, including, but not limited to, any implied warranties of merchantability, fitness for a particular purpose, title or non-infringement or any other warranties that may arise from usage or trade or course of dealing.


Warranty Terms for Specific Goods

Upholstered Furniture: Muskoka Living's warranty for all upholstery products becomes null and void in the case of any reupholstery or unauthorized repair of said goods. The lengths of all warranties below are determined from the date of delivery, defined as the ship date from our factory noted on the Company invoice, and are valid only for original customers with proof of ownership (an original sales receipt). All Muskoka Living warranties are null and void when goods are re-sold to a second user. Muskoka Living voids its cushion AND covering warranty if any non-authorized after-market soil, fabric or leather protection, or chemical is applied, including any stain guard protection.

Any pieces made or intended for outdoor use are NOT warrantied. 

Frames and Springs: Muskoka Living's frames and springs, when subjected to normal use under normal conditions, are warranted for as long as the upholstered product is covered in its original fabric or leather. Unfinished (raw) legs are excluded from warranty.

Swivel Mechanisms:
Swivel mechanisms are warranted for ONE (1) year.

Polyester Soft Fill Cushions: Polyester Soft Fill Cushions are warranted against loss of resiliency for FIVE (5) years from date of delivery. Loss of resiliency does not include any slight softening of a cushion or the flattening of the fiber top.

Feather and Down Cushions: Feather and Down Cushions are warranted against defects in materials and workmanship for a period of THREE (3) years. 

Tight Seat Cushions: Tight Seat Cushions are warranted against defects in materials and workmanship for a period of ONE (1) year.

Fabric: Manufacturers of upholstery fabrics do not warrant their products for durability or colorfastness. While Muskoka Living makes every effort to select fabrics that are durable and colorfast, we regret that we will be unable to honor adjustments, claims, or credits based on durability or colorfastness. Fabric coverings, other than Customer's Own Material (COM), are warranted for ONE (1) year against manufacturing defects, seam slippage, pilling (unless pilling is a natural characteristic), shrinkage, and nap loss. On all upholstery products, Muskoka Living tries to align and match fabric patterns; however, in most cases tufting will not allow exact alignment and matching of fabric patterns. The Company does not offer warranty for COM.

Leather:  Leather coverings, other than Customer’s Own Leather (COL) are warranted against tearing, splitting and seam slippage for ONE (1) year. The Muskoka Living warranty does not cover natural characteristics of individual hides such as wrinkling, markings, or variations in grain, color or hand. The Company does not offer warranty for COL.

Case Good Furniture: 

Muskoka Living's oak case goods are made with Grade A select white oak and finished with semi-transparent stains that highlight each piece and its unique identity. As a result, our products may vary in shade, texture or markings. These are not considered defects of the product, but rather a beautiful reminder of its organic nature. 

Wood products are warranted to be free of defects in materials and workmanship for a period of ONE (1) year. As wood products adapt to different climates, they can shift in size which may result in some cracking. This is a completely normal response to the furniture's environment and not covered under our warranty. The best way to minimize any cracking is to keep pieces in conditions that are moderate in both temperature and humidity. Keeping case goods in extreme conditions such as highly air conditioned, heated or humid areas, should always be avoided. 

Any pieces made or intended for outdoor use are NOT warrantied. 

 

Limestone Case Goods: Muskoka Living's limestone furniture pieces are made with solid wood frames and finished using our proprietary multi-step limestone micro-coat process. As a result, our products may vary in texture or markings. Much like our oak case goods, these are not considered defects of the product, but rather a beautiful reminder of their unique nature. 

Warranty Limitations and Exclusions

Disclaimer of Implied Warranties
"Implied warranties," herein signifies warranties that the law sometimes implies to have been given by the seller even though they are not set out in writing: Muskoka Living makes no implied warranties of merchantability or fitness for a particular purpose. These and all other implied warranties are specifically disclaimed.

Place of Purchase and Manufacturer
This warranty protects only goods purchased by an original owner directly from a Muskoka Living Customer; no re-sold goods are protected under warranty. In addition, this warranty only applies to goods that are manufactured by Muskoka Living and does not apply to any goods manufactured by third-party suppliers or vendors.

Residential Use
This warranty applies only to Muskoka Living goods purchased for normal indoor/outdoor residential use and does not cover goods for commercial use.

Improper Care and Use
Like all quality furniture, Muskoka Living's products require routine maintenance, and proper care and use are essential to preserving all rights under this warranty. This warranty is void if improper maintenance or improper use causes damage to goods, including the use of detergents, abrasives or other harsh cleaning agents.

Accidents, Abuse and Normal Wear and Tear
This warranty does not cover damage to goods resulting from negligence, abuse, normal wear and tear, or accidents, including burns, cuts, scratches, tears, scuffs, watermarks, indentations or pet damage.

Product Modification
Any modification made to any products are not authorized by Muskoka Living will void this warranty.

Floor Samples or Products purchased from the Annex
This warranty does not cover floor samples or other goods designated as Annex items at the time of purchase.

Differences from Floor Samples or Literature
Since Muskoka Living's products are all hand-crafted from natural materials, minor variations can occur from piece to piece, and as such this warranty does not cover such minor variations, or differences between floor samples or printed illustrations and actual goods delivered.

Consequential or Incidental Damages
Muskoka Living will not be liable for consequential or incidental damages. “Consequential and incidental damages” is herein defined as any loss, expense, or damage other than to the goods themselves that may result from a defect in said goods.
